Articles of Incorporation
The Articles of Incorporation is a short document that sets the name of the HOA, asserts that it is a nonprofit mutual-benefit corporation, and identifies its initial agent, the individual authorized to receive legal notices on the HOA’s behalf. This document created the Montage at Mission Hills Homeowners Association as a legal entity under the laws of the State of California and set out the purposes for which the association was formed. Bylaws
Bylaws establish qualifications and procedures for the election of the Board of Directors, their term of office, their powers and duties, etc. Bylaws also contain procedures for annual and special meetings of the membership. The Board may amend certain elements of the Bylaws; other parts require membership approval. Corp. Code §7150

Board Policies set out and guide the actions of the Board of Directors, clarify the components and implementation of its legal fiduciary responsibilities, and guide the completion of more routine work.

Covenants, Conditions & Restrictions (CC&Rs)
The Declaration of Covenants, Conditions, Restrictions, and Reservation of Easements, otherwise known as the “Declaration” or the “CC&Rs,” describes the rights and obligations of the membership to the Association and the Association to the membership. This includes maintenance responsibilities and restrictions on the use of the property. To be effective, CC&Rs must be recorded. Civil Code §1355(a)

Community Rules and Regulations
The Montage at Mission Hills Rules and Regulations serve as the framework for behavior and ownership responsibilities in Montage as adopted by the Board and approved by Homeowners.

Election Rules
The Montage at Mission Hills Election Rules is a part of the Association’s Bylaws. The 2020 Election Rules were modified due to changes made by the State Legislature in October 2021. The governor signed the bill into law effective January 1, 2022. The Board posted and then circulated the draft Rules to each member household for a 28-day review and comment in March 2022 and again in June 2022. The Board adopted the Rules at the July 8, 2022, Board meeting.

Insurance Summary Disclosure
30 to 90 days before the start of the fiscal year, the HOA will provide summaries of the Association’s property, general liability, and fidelity insurance policies, which state the insurer’s name, type of insurance, policy limits, and deductibles. The Association must also notify members if policies are canceled and not immediately replaced—Civil Code 1365(f).

Workers Compensation Insurance Summary Disclosure
The Montage at Mission Hills Board of Directors has decided to maintain Worker’s Compensation Insurance even though the Montage at Mission Hills Homeowners Association has no employees. The decision to carry the insurance is based on the recommendation of the Community Associations Institute (CAI) and the advice of our lawyers. If one of the contractors we hire allows their Worker’s Compensation Insurance to lapse and one of their employees is injured, they legally may attempt to come to the Association as the employer.

Davis-Stirling Common Interest Development Act
While not an Association document, the Davis-Stirling Common Interest Development Act, or the Davis-Stirling Act, is the primary set of State laws that govern a Common Interest Development (CID) and Homeowners Association (HOA) in California. The Act has been amended many times since 1985. On January 1, 2014, the Act was wholly renumbered and reorganized, codified in California Civil Code, and will continue to be amended to address the changing legal landscape affecting Associations. The Act provides the legal framework by which the Montage at Mission Hills Homeowners Association must operate. The Act offers latitude for Associations to adopt rules, regulations, policies, and procedures to guide the management and operation of the Association as long as those instruments do not conflict with or abrogate the provisions of the Act.

Montage At Missionn Hills Landscape and Lighting Maintenance District - Zone 7
The information here is related to The Ford DaVall Group, LLC and the City of Cathedral City’s formation of a landscape and lighting maintenance district in 2001 to tax the owners of the 128 lots within Montage for 50% of the maintenance repair, replacement, and operation of improvements within the newly established district. Zone 7. Zone 7 is part of a City-wide LLMD containing approximately 20 Zones.
Each year, as a part of its budget process, the City contracts to have an engineering report prepared relative to the annual cost of the maintenance and operations of the Montage Zone 7 LLMD. Based upon that report, the City Council then adopts a resolution in June of each year authorizing the County to collect funds sufficient to pay all costs associated with operating the district, Cost responsibility is distributed equally to each residential lot within the District Zone. Costs have typically averaged between $50 and $60 per year. An example of an annual property tax bill with LLMD assessment highlighted is attached here for reference.
